Terms of Use

1. Introduction

The use of the Tamkeen Bahrain mobile application and the services (the “Tamkeen App”) provided by Tamkeen (collectively referred to as ‘Tamkeen’, ‘we’, ‘us’ or ‘our’) is subject to the following Terms of Use (“Terms”). These Terms govern the use of all content and services available through the Tamkeen App and form the relationship between Tamkeen and the Users (you’ your’). By creating an account, registering with Tamkeen, or using the services provided via the Tamkeen App, you acknowledge and agree to be bound by these Terms. 

2. Tamkeen Services and Legitimate Use 

You will use the Tamkeen App solely in connection with obtaining support from Tamkeen Programs. 

Submission of a request for Tamkeen Programs does not guarantee approval and shall be subject to the terms and conditions of the selected Tamkeen Program. 

3.ProhibitedUse of the Tamkeen App 

You agree to use the Tamkeen App only for the purposes of obtaining services from Tamkeen and You shall not to use the Tamkeen App for any unlawful purpose or in any way that could damage the Tamkeen App and/or Tamkeen’s business, operations, Tamkeen’s goodwill rights or in any manner inconsistent with these Terms. 

You further agree not to use the Tamkeen App to: 

• Violate any Tamkeen Intellectual Property or the intellectual property of a third party. 
• Harass, abuse or threaten others or otherwise violate any person’s legal rights. 
• Upload or otherwise disseminate any computer viruses or other software that may damage the Tamkeen App or the property of a third party. 
• Illegally scan or penetration of any of Tamkeen’s websites, Tamkeen’s portal, Tamkeen’s App and/or any of Tamkeen’s cloud-based assets. 
• Disclose or share critical vulnerabilities with others either publicly or privately. 
• Engage in any fraudulent illegal, and/or unlawful activities. 
• Engage in any activities that threaten the security of the Tamkeen App. 
• Publish or distribute any obscene, defamatory or infringing material. 
• Unlawfully gather information about Tamkeen or Tamkeen’s App users, customers, clients, and/or beneficiaries. 

The above list is non-exhaustive. Tamkeen reserves the right to take further action in accordance with relevant laws if any of the above or similar occurrences are discovered. 

4.Your Duty to Provide Accurate Data

It is important that any data including personal and/or sensitive personal data provided by you to us is kept up to date and accurate. You agree not to use any false/misleading or inaccurate data/information when registering or utilizing any of the services provided under the Tamkeen App.

5. License to Use the TamkeenApp

Tamkeen may provide you with certain information in the form of documents, data or information developed by Tamkeen or other materials (“Tamkeen Materials”).  Subject to these Terms, Tamkeen grants you a non-exclusive, limited, non-transferable and revocable license to use Tamkeen Materials solely in connection the legitimate use and not for any other purpose. 

6. Intellectual Property Rights

You agree that the Tamkeen App is the property of Tamkeen including all copyrights, trademarks, trade secrets, patents and other intellectual property (“Tamkeen Intellectual Property”). You agree that Tamkeen owns all rights, title and interest in Tamkeen’s Intellectual Property and you will not use Tamkeen’s Intellectual Property for any unlawful or infringement purposes. Any redistribution or reproduction of part or all of the contents of the Tamkeen App in any form is prohibited other than for printing or downloading for personal and non-commercial use. You may not transmit or store all or part of the contents of the Tamkeen App in any other form of electronic retrieval system. 

7. Service Availability and Interruptions

Tamkeen does guarantee uninterrupted or error-free access to the Tamkeen App. Tamkeen reserves the right to perform periodic maintenance or emergency maintenance on a scheduled or unscheduled basis. You hereby acknowledge that your access to the Tamkeen App may be affected by such service interruptions for time to time. Tamkeen will not be liable for any damage or loss caused as a result of such interruption. 

8. The AppleStore and Google Play’s terms also apply

The ways in which you may use the Tamkeen App may also be controlled by the Apple Store and Google Play’s rules and policies. 

9.Eligibility to use the Tamkeen App

You must be 18 years old or older in order to use the Tamkeen App and to accept these Terms. 

10. If someone else owns the phone or device you are using

Using your account on a device that does not belong to you may expose you unauthorized access to your personal information, theft or misuse of your login credentials, compromise of your account, privacy breaches, and non-compliance with these Terms. We strongly recommend using your account only on your personal device and logging out immediately if you access it elsewhere. You will be ultimately responsible for complying with these Terms where you’ve provided access to your account to others unless you can prove that such access has been obtained unlawfully at no fault of your own. 

11.Warranties

Tamkeen makes no representation or warranties of any kind, express or implied about the completeness, accuracy, reliability, suitability or availability with respect to the Tamkeen App for any purpose, including but not limited to the implied warranty of fitness for a particular purpose and the implied warranty of merchantability. Tamkeen makes no warranties that the Tamkeen App will be uninterrupted, error-free or secure. You are liable and responsible for any damage that may be sustained through your devices or as a result of loss of your data from your use of the Tamkeen App. Tamkeen shall not be liable for any such damage or loss. 

12. Third Party Links

Use of any third party linked available on the Tamkeen App shall be at your sole discretion and responsibility. Tamkeen is not responsible or liable for any loss or damage caused as a result of your use of any third-party services linked to the Tamkeen App. 

13.Suspension of Services

Failure to comply with these Terms may result in suspension of your account temporarily or permanently and Tamkeen reserves the right to take any action available to it under applicable law including referral to the concerned entities including Public Prosecution or the Courts of the Kingdom of Bahrain. 

14.Disclaimer

You acknowledge and agree that any information posted on the Tamkeen App is not intended to be legal or financial advice and no fiduciary relationship has been created between you and Tamkeen. Tamkeen does not assume responsibility or liability for any advice or other information provided on the Tamkeen App. 

15. Modification of these Terms

Tamkeen reserves the right to modify/update these Terms at any time without prior notice.  You agree to routinely review these Terms on the Tamkeen App and that your continued use of the Tamkeen App after any modifications to these Terms is a continued acceptance of these Terms.

17.Governing Law

These Terms are governed and construed by the laws of the Kingdom of Bahrain.
